Charter Terms & Conditions
It is agreed as follows:
1. The Charterer shall pay a 25% non-refundable deposit on confirming booking with the balance payable no later than 14 ordinary days before charter.
2. The Charterer agrees that the maximum number of passengers to be accommodated on the Vessel at any time during the charter shall not exceed 8.
3. The daily rate shall cover and include fuel, food and beverage, crew of four (including Captain), tender boats and fishing equipment, normal supplies and maintenance. For the avoidance of doubt it does include tips for the crew.
4. Only the Captain may drive the Vessel and the tender boats may only be driven by the Captain or crew. Under no circumstances may the Charterer or his guests drive the Vessel or any of the tender boats. On board the Vessel the Charterer and guests must observe safety standards properly required by the Captain and while in the tender boats the Charterer and his guests must wear lifejackets which will be provided. In the event of any breach of this condition, the Owner shall (through the Captain and crew) have the right to retake possession of the Vessel and to terminate the charter.
5. At all times when the Vessel is being driven by or is under the control of the Captain and crew, the Owner assumes all risk of loss of or damage to the hull or structure of the Vessel.
6. The Charterer undertakes this charter entirely at his own risk. The Charterer hereby indemnifies the Owner and its directors and to hold them fully indemnified against all losses, damages, costs, expenses, claims, demands or proceedings whatsoever and howsoever suffered or incurred by the Owner (or its directors) and arising directly or indirectly out of this charter, whatsoever and howsoever.
7. The Charterer shall only consume alcohol in moderation and will not indulge in any illegal drugs. The Charterer and all pax will sign standard disclaimer and indemnity upon entry to the Vessel. The laws of Zimbabwe apply to this contract.
